With some 20 officially recognised sovereign languages, the EU's inclusive philosophy renders the task of running the European Parliament a truly formidable one. The problem is highlighted by two interesting facts; firstly, only around 40% of Europeans are multilingual and secondly, 20 languages yield a total of around 190 possible language combinations (e.g. German-French, Czech-Greek, Danish-Dutch etc).

The implications of these figures are truly astounding. To run a single session of the European Parliament requires a minimum of three interpreters per translation booth; this means that each session requires at least 60 interpreters to be able to function at all.

Even before new countries accede to the EU, as was the case recently with the ascension of Romania and Bulgaria, the corpus of existing EU law, the acquis communautaire, consisting of some 90,000 pages, must be translated into that country's language. Although the responsibility for this rests with sovereign governments, this still leads to an EU led recruitment of translators within the sovereign countries. Additionally, once the translations are complete, the EU will be responsible for finalizing and publishing them, and for hiring translators of these languages for permanent roles within the European Parliament.

The body responsible for fulfilling the EU's needs for translation and linguistic advice is the Directorate General for Translation (DGT). The DGT has a permanent staff of 2,200 linguists who are stationed in Brussels and Luxembourg. The DGT is organized along language lines with a separate department for each official language. Each department is further divided up into units which specialise in EU policy areas, such as agriculture, energy and employment - each unit has a minimum of 20 translators.

The current number of full-time EU translators and interpreters is truly staggering, as is the cost estimated at some EUR 800 million in 2006, with the trend only looking to increase. For an idea of the possible magnitude of future recruitment, let us look at the figures for the last expansion. This expansion led to the recruitment of 473 additional full time translators, additionally the DGT recruited 7 'seconded national experts' from the ascension countries and a total of 27 support staff (although 99 more are still to be engaged). On top of this the DGT also outsources work to freelance translators and translation agencies in the UK and across Europe.

Any new countries wishing to join the EU will precipitate a similar wave of recruitment of linguists and support staff. With this huge recruitment of translators, along with the maintenance of current staffing a necessity for the EU to even function, the EU's tower of Babel is looking decidedly creaky!

I have done many short sale in the past 15 years and have faced rejection from lenders and homeowners 20-30% of the time. Does rejection bother me? Not in the least and I love it, since It provides more information so that I can improve my negotiation skills As with any sales tactic, I am playing a numbers game and there is no game better than the short sale game which can make you wealthy beyond your dreams.

Most agents, investors or even lenders do not know how a short sale works or how to negotiate a short sale successfully There are no seminars, Gurus or get rich quick schemes in the short sale industry and do not let anyone fool you. Short sale transactions are learned with experience and there in no one way of doing it. Each short transaction is a separate animal on its own with separate investors and numbers. There are very few investors who truly know how to successfully negotiate a short sale. Most investors have the perception that all that is necessary is to submit an offer and wait for the bank to give you an answer. If all goes well the offer will be accepted but in many cases it's not that simple. That's why a strategic plan is necessary before you even begin a short sale. You must set up a plan to persuading the lender to agree with your offer.

There are 2 key steps that will ensure success when negotiating a short sale with lenders:

1st. Evaluate all the numbers that the owner give you, such as the total amount of the 1st, 2nd or even 3rd trust deeds and determine if you indeed have a short sale opportunity on your hands. Obviously, if the total balance of all liens is greater that the "as is market value" of the property than you may have a candidate. The next step would be to qualify the homeowner to determine if they are truly in financial hardship and most homeowners are, especially if they are behind on their payments.. Many rookie investors are under the misconception that every homeowner facing foreclosure is a good short sale candidate. Not all deals are good short sale opportunities. You must know the difference between a good and a bad deal.

2nd Don't take no for an answer. If the lender says no you must ask yourself why? Lenders do not make decisions based on emotion, unlike most homeowners, their only concern is to negotiate and get the highest price on their investment and trust me, they will say no to offers dozens of times. When the end approaches and the property is scheduled to sale at auction, they may very well say yes to your offer. I personally expect to get a no on my first offer and second counteroffer before we get down to the real serious numbers in purchasing any given property.

Here is an deal which I recently purchased that I would like to share with you, the property was located in Los Angeles:

I got a call from an owner in distress on one of my advertisements. This owner was behind 3 months and a notice of default had already been filed. He had a 1st loan amount of $585,000 and 2nd loan amount of $95,000 the property was worth $620,000 in it's as is condition. I immediately had him sign an "authorization to release" and contacted the 1st lender within 2 days and asked them to send a short sale package, which they did. Long story short, my initial offer for the 1st and 2nd combined since one lender held both was $480,000. They send out their broker for a BPO or "brokers price opinion" which came in at $600,000 they countered me $580,000 back and forth some more and the final purchase price was negotiated to $495,000. I sold the property within 30 days for $605,000 netting $580,000 after commissions and closing costs. Net profit from this one deal was $70,000. Not bad for 3 months work.

This would have never happened if I accepted no from the bank. I must have received a "no" several times from the loss mitigator but I knew that if I was persistent and aggressively polite they would reconsider. Remember, the next time you are putting together a short sale offer, be prepared and take control of the deal. Never take NO for an answer. Be proactive not reactive. Don't just submit offers without having a game plan. Do yourself a favor and take advantage of the opportunity to make lots of money in an industry where great deals are hard to come by.

Step By Step Short Sale Process

To make things easier for realtors here is the information you will need to do a short sale. Investors can use this guide also there are just a few things that are done differently.

1. Get a list of people in foreclosure or work from your referral base to send letter to potential clients in foreclosure.
2. Talk with homeowners
3. Meet with homeowners in foreclosure
4. Tell them you are a realtor and that you will be contacting the bank to list your property at a discount + your fee.
5. Get paperwork from homeowner to show the bank that there is a hardship.

6. Paperwork includes:

a. Authorization to Release Loan Information

b. Cover letter

c. Listing contract agreement

d. 2 year tax returns

e. W-2

f. 2 Months Bank Statements

g. Hardship letter

h. Personal financial statement
7. Call bank or lender to get loss mitigation number or use the list in this book.
8. Contact loss mitigation and fax over authorization
9. Call 2 days later and make sure the authorization is in their system.
10. Once authorization is in system, send over short sale package to the loss mitigation fax. (Note the fax may be the same for the authorization and short sale package)
11. Wait 3 to 5 days call loss mitigation to make sure they got the paperwork.
12. Meet BPO appraiser at the property to get the price that you need to sell the house at.
13. Once assigned to negotiator, then work with them to get the price you need to sell the property and get the time you need to sell it.
14. Once you get the ok from the negotiator, sell the property.
15. Sometimes in the MLS you will see the agent put short sale contingent upon bank approval. This has to do with the offers, if it is too low the banks will not sell.

Do Lenders Really Mistreat Foreclosure Victims?

The question of whether lenders mistreat foreclosure victims has two sides and both are based on historical fact. The lenders' side is homeowners are financially irresponsible and are breaking a legal contract with the lender. The homeowners' perception of the foreclosure is that the lender is unresponsive to their need for help and wants to steal their home. Ironically, any or all of these accusations can be true at the same time.

The lender makes money from a couple of sources when they give mortgages or deeds of trust to homeowners to finance a home purchase. The most obvious is the interest charged on the loan. The lender makes the difference between the borrowed cost of money and the final interest rate charged the homeowner. Lenders borrow money from its savings account holders and the Federal Reserve. The lenders also make money from the closing points charged the borrower, which can be equivalent to many monthly mortgage payments. Since the average homeowner owns a home for about five years, the lenders get these closing costs (points) over and over from the same borrower. Other income comes from the sale of the lender's foreclosed properties called REO's (Real Estate Owned). Yes, banks can and do make money on foreclosures. It is not a calculated part of their income stream but it does happen particularly when the lender plans it by taking equity-rich properties back from homeowners.

The homeowners' perception may also be correct because the lender is often unresponsive or not supportive because it is one of tens of thousands the lender has to deal with at any given time. The lender's loan mitigation officer may have hundreds of files working at one time and is often unreceptive to calls from homeowners. A very few lenders have developed departments with field personnel to visit the homeowners and show them solutions. The lender gets an appraisal or BPO (Broker's Price Opinion) as soon as the loan is delinquent by a few weeks. This estimated fair market value of their home is used to determine whether the lender can get the remaining loan balance back from the sale of the property. This estimated resale value has to affect how the borrower will be treated, either with an aggressive attitude to get the property back and get the home's equity by offering a "Deed in Lieu of Foreclosure", or with a different legal approach to have the homeowner keep the problem property.

Lenders use strictly a financial determination to resolve the problem of the foreclosure because it is in their best interests. This cut-and-dry decision often results in the homeowner getting minimal help from the lender. Homeowners can simultaneously be correct in their perceptions because the lender may want their property for its equity and homeowners only see that the loss mitigation representative is unresponsive to their phone calls. The best solution is for the homeowner to steer the foreclosure process and understand his rights without possible biased help from the lender.

Using a "Deed in Lieu Of" to Stop a Foreclosure

Recently lenders have been taking deeds in lieu of foreclosure from homeowners to resolve foreclosures. The lender simply accepts a deed in exchange for forgiving the homeowner of his mortgage or deed of trust loan.

Let's look more closely and see the ramifications of this legal transaction. It usually starts after the homeowner has fallen behind on his loan payments and is considering foreclosure, or he has already been served with a "default notice". Time is against the homeowner because the lender will or already has started foreclosure proceedings. The homeowner is being bombarded by outside information sources because his foreclosure has become a part of the public record or he is getting information from well-meaning but uninformed people.

As soon as the homeowner notifies the lender of his impending problem or his loan is delinquent, the lender orders an appraisal or BPO (Broker's Price Opinion) to determine its market value. The lender now knows if he can make money on the property if he takes it back at a foreclosure auction. The lender's decision will be strictly financially motivated from this point forward. The risk of taking the property by foreclosure includes the higher legal costs, an extended loss of interest on the loan, real estate market risk, realtors®' commissions, and any other open liens on the property that can't be extinguished at the auction. The lender now factors in the minimal cost and shorter time required to get the home by taking a deed from the homeowner but in lieu of continuing the foreclosure. If the appraisal comes back with a value of 80% or less of the loan balance due, the lender would be irresponsible to take the deed and would continue the foreclosure. The other determining factor is whether there are other liens against the property such as a second mortgage or mechanics liens. Sometimes these liens can be larger than the first mortgage and the lender will not accept the property with these liens still attached to it.

If the lender agrees to accept a deed in lieu of foreclosure, it is not completely over for the homeowner. The lender will submit an Acceptance Agreement that the homeowner must sign as well as a new deed. The terms of this agreement may stipulate that if the lender sells or transfers the property for less than what is owed on the loan (including all penalties, interest, and attorneys' fees), the guarantor of the loan will owe the lender this difference. This deficiency amount can then be granted by the courts as a deficiency judgment against the loan guarantor.

So is the "Deed in Lieu of" an ideal solution for a homeowner in foreclosure? Not unless the terms of the Acceptance Agreement release the guarantor from future liability (deficiency judgment). Another option is to sell the property at a break-even point and repay the loan then his credit report won't be negatively impacted by the lender's reporting a loan write-off as with the deed exchange.
